Permits in Hamilton, Ontario

Quick Permit Notes

In Hamilton, accessory structures under 15 m2 (approximately 160 sq ft) typically do not require a building permit. For structures that do require a permit, the following rules generally apply under the City of Hamilton zoning bylaw, though requirements can vary by zone and lot type.

  • Setbacks: typically a minimum of 0.6 metres (2 feet) from rear and side lot lines, though some zones require more
  • Height: maximum 4 metres for flat or low-slope roofs in most residential zones
  • Lot coverage: accessory structures combined with the main dwelling typically cannot exceed the maximum lot coverage for your zone, often in the range of 40 to 60 percent depending on designation

Hamilton's escarpment and waterfront zones may carry additional restrictions. Properties near the Niagara Escarpment may fall under Conservation Authority jurisdiction, which can add a separate approval layer.

Always confirm current requirements directly with the City of Hamilton Building Division before starting any project. Bylaws change and your specific lot may have conditions that differ from the general rules above.
